Section 7 — Personal Suretyship

I/We, the undersigned, do hereby bind myself/ourselves jointly and severally as surety/ies and co-principal debtor(s) in solidum with the Applicant in favour of Arken Optics (Pty) Ltd ("the Creditor") for the due and punctual payment and performance by the Applicant of all obligations which the Applicant may now or hereafter owe to the Creditor, arising from or in connection with the credit facility applied for herein.

This suretyship shall be a continuing covering suretyship and shall remain in force until all obligations have been fulfilled. The surety/ies hereby renounce the benefits of excussion, division, and cession of actions.

By signing this application, the Applicant and Surety/ies declare and confirm that:

Arken Optics (Pty) Ltd is authorised to make any enquiries it deems necessary to verify the information provided herein.
Arken Optics (Pty) Ltd is authorised to conduct credit checks with any registered credit bureau and to obtain a credit profile on the Applicant and its directors/members.
The Applicant agrees to be bound by Arken Optics' standard terms and conditions of sale, as amended from time to time.
The credit facility, if granted, may be varied or withdrawn at any time at the sole discretion of Arken Optics (Pty) Ltd.
Interest may be charged on overdue accounts at the maximum rate permitted by the National Credit Act or applicable law.
The Applicant shall be liable for all costs of collection, including legal costs on an attorney-and-own-client scale.
The Applicant consents to the jurisdiction of the Magistrate's Court in terms of Section 45 of the Magistrate's Courts Act, notwithstanding that the claim may exceed the jurisdiction of such court.
A certificate by any director or manager of Arken Optics (Pty) Ltd as to the amount owing shall be prima facie proof of the Applicant's indebtedness.
This application and any credit facility granted pursuant thereto is subject to the final approval of Arken Optics (Pty) Ltd.
